Terms, acceptable use and privacy information for NCCK services.
1. Agreement & Parties
The use of services provided by NCCK Global ("NCCK", "we", "us") is subject to these Terms of Service (the "Agreement"). NCCK is the operator of ncck.com (the "Site"), through which we provide cloud servers, dedicated servers, IP-rich servers, high-defense servers, colocation, IP transit and related infrastructure services (the "Services") from facilities in Hong Kong, Seoul and Los Angeles.
By placing an order, clicking "I accept" or using the Services, you ("Client", "you") agree to be bound by this Agreement in full. If you do not agree, do not use the Services.
2. Revisions to this Agreement
NCCK may revise this Agreement at any time. Material changes will be announced on the Site or by email at least 7 days before taking effect. Continued use of the Services after the effective date constitutes acceptance of the revised Agreement.
3. Duration & Cancellation
Services are billed in prepaid cycles (monthly, quarterly or annually) and renew automatically upon payment. You may cancel any service from the client area at any time; cancellation takes effect at the end of the paid cycle unless immediate cancellation is requested.
Upon cancellation or termination, all data on the service is scheduled for destruction and cannot be recovered. Export your data before the end of the billing cycle.
4. Account Management
You must provide accurate, current contact information and keep it updated. You are responsible for all activity under your account and for safeguarding credentials, including enabling two-factor authentication where available. Accounts may not be sold or transferred without our written consent.
5. Ordering & Provisioning
Cloud services are provisioned automatically after payment confirmation. Dedicated, high-defense and colocation services are provisioned within the lead time stated on the order page. Line type (CDIA / DIA / Global), bandwidth and defense packages are selected at checkout and form part of the service specification.
6. Payment & Billing
Invoices are generated before the due date and must be paid by the due date. Overdue services are suspended; services overdue beyond 7 days may be terminated and data destroyed. A service is only considered paid when funds are irrevocably received.
You are responsible for any transaction fees, withholding or local taxes applicable to your payments.
7. Refund Policy
Except where required by law or expressly stated in a promotion, all fees are non-refundable once a service has been provisioned. Setup fees, add-ons (including DDoS packages and IP allocations), and month-to-month renewals are non-refundable in all cases. Refund requests arising from our failure to deliver a service may be submitted by ticket.
8. Uptime Guarantee (SLA)
We target 99.9% monthly network availability per location. Where availability falls below target due to faults within our direct control, you may request service credits by ticket within 7 days of the incident. Credits are calculated against the monthly fee of the affected service and are your sole remedy for downtime. Scheduled maintenance, upstream carrier faults, DDoS mitigation events and force majeure are excluded.
9. Resource Usage & Security
You must not consume resources in a way that degrades the platform or other clients, and you must keep software on your services patched and secured. We may isolate or rate-limit a service that is compromised, participating in an attack, or emitting abusive traffic, with notice where practicable.
10. Backups & Data Loss
The Services are unmanaged and provided without backup unless a backup add-on is expressly included. You are solely responsible for maintaining independent copies of your data. NCCK is not liable for data loss from hardware failure, your actions, compromise of your service, or termination for breach.
11. Zero-Tolerance Spam Policy
Sending unsolicited bulk email, hosting spam-advertised content, or operating open relays/proxies from the Services is prohibited. Violations may result in immediate suspension, a cleanup fee, and forfeiture of IP allocations, including entire /24 blocks on IP-rich services.
12. Intellectual Property & Takedown
You retain rights to your content and warrant that it does not infringe third-party rights. We respond to properly formed infringement notices (including DMCA-style notices) delivered by ticket or to our abuse contact, and may remove content or suspend services identified in a valid notice. Counter-notifications are accepted through the same channels.
13. No Warranties
The Services are provided "as is" and "as available". To the maximum extent permitted by law, NCCK disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. Route quality figures, latency values and mitigation capacities published on the Site are reference values, not guarantees.
14. Limitation of Liability
To the maximum extent permitted by law, NCCK's aggregate liability arising out of or relating to the Services shall not exceed the fees paid by you for the affected service in the one (1) month preceding the event. NCCK shall not be liable for indirect, incidental, special or consequential damages, loss of profits, or loss of data.
15. Suspension & Termination
We may suspend or terminate Services immediately where required by law, where continued operation threatens the platform or other clients, or upon material breach of this Agreement or the Acceptable Use Policy. Repeated violations may result in account closure without refund.
16. Governing Law & Contact
This Agreement is governed by the laws of the Hong Kong Special Administrative Region, without regard to conflict-of-law rules. Disputes shall be submitted to the courts of Hong Kong. Questions about this Agreement may be raised via the ticket system or our contact page.
1. Scope
This Acceptable Use Policy ("AUP") applies to all NCCK Services and is incorporated into the Terms of Service. We may update it as threats and regulations evolve.
2. Prohibited Content
You may not host or transmit content that is unlawful in Hong Kong, the service location, or your own jurisdiction — including child sexual abuse material, terrorist content, stolen data, malware distribution, phishing pages, or counterfeit-goods storefronts.
3. Network Abuse
Port scanning, unauthorized penetration attempts, IP spoofing, launching or coordinating denial-of-service attacks, and BGP manipulation are prohibited. High-defense services protect your workloads; they may not be used as a shield for attack infrastructure.
4. Email & Messaging
Unsolicited bulk email, SMS spam, and messaging abuse are prohibited under the zero-tolerance policy in the Terms of Service. Bulk senders must maintain provable opt-in records and functional unsubscribe mechanisms.
5. IP Address Usage
IP allocations (including /24 blocks on IP-rich services) remain NCCK property and must be used on the assigned service with accurate rDNS where configured. Abuse originating from an allocation may result in reclamation of the entire block.
6. China-Direction Traffic
Services using CDIA or China-optimized routes must comply with applicable mainland regulations for the traffic they carry. Persistent violations that jeopardize carrier relationships (CN2 GIA and partner routes) may result in migration to Global lines or termination.
7. Resource Fairness
Sustained abuse of shared resources — including CPU steal on cloud platforms, bandwidth beyond the purchased committed rate, or storage IO patterns that degrade neighbors — may be rate-limited after notice.
8. Enforcement & Reporting
Violations may result in warning, rate-limiting, suspension or termination depending on severity, generally with notice except for emergencies. Report abuse originating from our network via the contact page with source IP, destination IP, logs and timestamps.
1. Scope
This Privacy Policy explains how NCCK Global collects, uses and protects personal data when you use the Site and Services. It applies to account holders, visitors and ticket correspondents.
2. Data We Collect
Account data (name, email, phone, billing address), billing records and invoices, service metadata (IP allocations, hostnames, configurations), support correspondence, and technical logs (login records, API calls, connection metadata necessary for security and billing).
We do not inspect the content of data stored on your services except as required for abuse investigation with cause, or by law.
3. How We Use Data
To provision and operate the Services, process payments, provide support, secure the network (including DDoS mitigation and abuse handling), meet legal obligations, and send service notices. Marketing email is sent only with your consent and can be unsubscribed at any time.
4. Cookies
The Site uses strictly necessary cookies for sessions, language and currency selection, and cart state. We do not run third-party advertising trackers.
5. Sharing & Processors
Data is shared only with processors necessary to operate the Services: payment providers (transaction data), Cloudflare (traffic metadata for international scrubbing), datacenter and carrier partners (technical data required for provisioning), and authorities where legally compelled. We do not sell personal data.
6. Retention
Account and billing records are retained for the period required by tax and accounting law. Service data is destroyed after termination per the Terms of Service. Technical logs are retained for up to 12 months for security purposes.
7. Security
We apply access controls, encryption in transit, two-factor authentication and audit logging to systems holding personal data. No method of transmission or storage is completely secure; we will notify affected users of a data breach as required by applicable law.
8. Your Rights & Contact
You may access, correct, export or request deletion of your personal data via the client area or by ticket, subject to legal retention requirements. Privacy inquiries may be submitted through the contact page.
